§ 14-8. Access to personnel files.

  • (a)

    Access to an employee's personnel file shall be limited to:

    (1)

    The employee or any individual who has written authorization from the employee to review the personnel file.

    (2)

    The human resources director, or designee, and the city manager, or designee.

    (3)

    The employee's supervisor and department manager.

    (4)

    Human resources staff members in the performance of their official duties, including responding to court orders or subpoenas.

    (5)

    Employees or agents of companies providing employee benefits, when necessary to determine eligibility or otherwise administer benefits to the employee.

    (6)

    Attorneys or authorized staff members of the city attorney's office, or legal counsel representing the city, when necessary to provide legal advice or representation to the city.

    (b)

    In addition to the provisions of subsection (a), above, when documents contained in an employee's personnel file are requested pursuant to the provisions of Title 39 of the Arizona Revised Statutes, any relevant documents will be individually reviewed and the request responded to accordingly, as required by applicable state and federal laws and regulations.
