§ 17-301. Definitions.

In addition to the definitions set out in Scottsdale Revised Code, sections 1-5 and 17-1, the following definitions apply to this article:

Combination of vehicles means a truck or truck tractor and semitrailer and any trailer that it tows but does not include a forklift designed for the purpose of loading or unloading the truck, trailer, or semitrailer.

Commercial motor vehicle means a vehicle or combination of vehicles used to transport passengers or property if the vehicle:

(1)

Has a gross vehicle weight rating of twenty thousand one (20,001) or more pounds; or

(2)

Transports passengers for hire and has a design capacity of seven (7) or more persons; or

(3)

Is used in the transportation of materials found to be hazardous for the purposes of the Hazardous Materials Transportation Act (49 United States Code Appendix, sections 1801 through 1812) and is required to be placarded under 49 Code of Federal Regulations, section 172.504, as adopted by the Arizona Department of Transportation.

Haul means loads of sand, dirt, gravel and construction debris.

Inclement weather means atmospheric conditions that affect the safe operation of an oversize or overweight load, including, but not limited to, wind, dust, fog, rain, and other precipitation.

Inspection Services Supervisor means the person whose duties include inspecting the use of the right-of-way, and successor or designee.

Oversize or overweight load means any vehicle, commodity, structure, equipment, container or item that:

(1)

Exceeds sixteen (16) feet in height;

(2)

Exceeds fourteen (14) feet in width;

(3)

Exceeds one hundred twenty (120) feet in length;

(4)

Exceeds two hundred fifty thousand (250,000) pounds; or

(5)

Has seven (7) or more axles.

Right-of-Way Supervisor means the person whose duties include managing the use of the right-of-way, and successor or designee.

Vehicle means a motor vehicle as defined in Arizona Revised Statutes, section 28-101, and includes conveyances, and the terms "combination of vehicles" and "commercial motor vehicle" as defined above.
