§ 19-1. Police badges, etc.
(a)
No person shall manufacture, make, sell, design or transfer any official police officer's badge, reserve police officer's badge, official police officer's identification card or reserve officer's identification card without the written authorization of the chief of police. Such person may deliver badges or identification cards only to the chief of police, and may manufacture only the number of badges or identification cards authorized by the chief of police. Nothing in this subsection shall be construed as affecting the manner in which contracts for the purchase of the badges or identification cards by the city are made.
(b)
No person shall manufacture, make, sell, design, wear, carry, have in his possession or transfer any identification card, badge, star, shield, miniature, or insignia, regardless of the size, shape or design, which has on it the words "Scottsdale Police," either used separately, together, or in a combination with any other words indicating connection with the police department; or which is identical in design with or resembles or may be mistaken for, the design of the official police officer's identification card, reserve officer's identification card, official police officer's badge, or reserve police officer's badge, except as expressly provided for in this section.
(c)
Notwithstanding the provisions of this section, the chief of police may authorize the manufacture and distribution of the following items for the official use of the department, which shall include distribution to officers, employees of the department, and members of the public, when such manufacture and distribution are determined by the chief of police to be in the best interests of the department and city:
(1)
Miniature facsimiles of the official police officers badge that are no larger than one-half the size of the official badge.
(2)
Items of personal property bearing reproductions of the official badge or other official police department insignia including, but not limited to, coffee cups, mugs, binders, report covers, notebooks, wearing apparel, hats, caps, headgear, jewelry and other similar items.
(d)
The wearing, carrying displaying or possessing of any item authorized for manufacture and distribution under subsection (c), above, shall not be unlawful acts, unless the items are used to facilitate a violation of section 19-2 of this article or any statute of the state that prohibits impersonating a police officer or a public servant.
