§ 19-8. Drug, toxic vapor, poison or narcotic incapacitation.

  • (a)

    No person shall be in a public place under the influence of toxic vapors, poisons, narcotics, or other drug not therapeutically administered, when it reasonably appears that the person may endanger himself or herself or other persons or property.

    (b)

    A violation of this section is a class one misdemeanor. In addition to any other penalty imposed, a person found guilty of this section shall be required to complete a court ordered drug screening, education or treatment program.
