§ 20-54. Responsibilities; uses.

  • (a)

    The general manager, community services department, or designee ("general manager") shall be responsible for the management and operation of the stadium, including the booking and scheduling of events. The general manager, in accordance with the provisions of section 20-52, as applicable, shall adopt such rules and regulations as are necessary to manage, maintain and operate the stadium.

    (b)

    The rules and regulations shall include a statement of permissible and prohibited uses of the stadium. No use of the stadium shall be permitted that would require structural modification, or that would cause appreciable damage to the facility or the turf. The rules and regulations shall also provide a method by which an applicant who has been denied the use of the stadium can appeal the denial to the parks and recreation commission.

    (c)

    The general manager shall develop a standard facility use agreement for the stadium ("facility use agreement") that shall be used to authorize use of the stadium for various types of events. The initial facility use agreement form shall be submitted to the parks and recreation commission for review and comment, prior to being finalized by the general manager.

    (d)

    The general manager shall have the authority to make minor additions and modifications to the facility use agreement as may be reasonably necessary to accommodate particular uses. Substantial changes shall be submitted to the parks and recreation commission for review and comment. The facility use agreement shall incorporate by reference the rules and regulations promulgated under the authority of subsection (a), above, and a copy of the rules and regulations shall be provided to each person, organization or entity contracting to use the stadium.

    (e)

    In the event that the general manager determines that the use of the prevailing schedule of fees and charges, or the facility use agreement form, is not in the best interests of the city, because of the nature, scope, uniqueness, public benefit or significance of a particular proposed event, the general manager may negotiate the terms of an agreement. All such negotiated agreements shall be at the direction of the city council and subject to its approval.
