§ 24-2. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Animal waste means any unsanitary waste from the breeding, raising, containing, maintaining or grooming of animals from stables, kennels, pet pens, chicken coops, places of residence, veterinary establishments or other places of a similar nature and includes any discarded parts or full bodies from the slaughter or natural caused deaths of animals.

    Bag, bagged, and/or bagging means the secure containment of materials by placing and tying such materials in a plastic bag.

    Brush means leaves, twigs, palm skins, grass and weed cuttings, tree limbs and shrubbery clippings not exceeding three (3) feet in length.

    Brushable material means tree limb and shrubbery clippings three (3) feet in length or longer and up to three and one-half (3½) inches in diameter.

    Bulk rubbish means wooden and cardboard boxes, crates, appliances other than white goods, large items of household furniture, and other refuse items which by size and shape are not readily containable.

    Business establishment means any public or private place, building or location utilized for the conduct of business or industrial enterprise, but shall not include any residential or multifamily dwelling units except those apartments, condominiums, and townhouses authorized for commercial services by the director of solid waste management. Hotels, motels, motor inns, and other like establishments providing lodging for travelers, long term care facilities and nursing homes are business establishments.

    Business Services Department Director means the business services department director of the city revenue collection function or his duly authorized agent including, but not limited to, the revenue collector and utility billing office.

    City-owned container means those containers supplied to residential or commercial refuse generators by the city, regardless of the fact that the cost of acquisition may have been passed on to another.

    Collection employee means any individual employed by the city for the purpose of effectuating the provisions of this article.

    Collection process means any manual or automated process by which the division collects solid waste or recyclable materials.

    Commercial waste means any refuse generated by a business establishment.

    Commercial recyclable material generator means any person in charge of, owning, managing, leasing, renting or occupying any business, industrial or commercial building other than single-family dwelling unit, including, but not limited to, stores, offices, factories, motels or hotels which generate recyclable material which is collected by the city, or its authorized agents.

    Commercial refuse generator means any person in charge of, owning, managing, leasing, renting or occupying any business, industrial or commercial building other than single-family dwelling unit, including, but not limited to, stores, offices, factories, motels or hotels which generate refuse, which is collected by the city, or its authorized agent.

    Composting means a controlled condition under which organic material decomposes and stabilizes.

    Construction waste means material from construction, remodeling, construction site preparation, including, but not limited to, rocks, trees, debris, dirt, brick, fill, plaster, and all types of scrap building materials.

    Containable rubbish means all putrescible and nonputrescible solid wastes, which meet the collection requirements of this chapter; including, but not limited to, wrapped garbage, wrapped small dead animals, wrapped or boxed ashes, excelsior, rags, bottles, crockery, bedding, clothing, carpets, leather, metal scraps, small mechanical parts, shavings, floor sweepings, brush and other similar waste or debris.

    Container(s) means any receptacle(s) used for the collection of refuse or recyclable material and as approved by the director.

    Container pull means the actions necessary to empty a roll-off container performed by collection employees.

    Director means the head of the division of solid waste management or the director's designee, as applicable.

    Filth means manure, excrement or similar substance.

    Garbage means putrescible and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.

    Hazardous waste means any chemical, compound, mixture, substance, or article that is designated by the Unites States Environmental Protection Agency, the Arizona Department of Environmental Quality or appropriate agency of the state to be "hazardous," as that term is defined by or pursuant to federal or state law. Hazardous waste includes but is not limited to medical wastes, toxic materials, insecticides, radioactive material, explosives, flammable and corrosive materials.

    Licensee means a person who has obtained and presently holds a valid license issued pursuant to City Code Chapter 16, Article XV, Section 16-478 to engage in activities which are, in part, the subject of this chapter.

    Medical waste means any solid waste which is generated in the diagnosis, treatment or immunization of a human being or animal or in any research relating to that diagnosis, treatment or immunization or in the production or testing of biologicals, including but not limited to medical sharps and biohazardous medical waste.

    Open area means any park, street, gutter, sidewalk, sewer, boulevard, alley, greenbelt, square, vacant lot, space, ground or other area where refuse material may accumulate.

    Person means a corporation, company, partnership, firm, association, or society, as well as a natural person.

    Prohibited substance means hazardous waste; any noxious or malodorous substance offensive to the senses which deprives a neighborhood or a considerable number of persons of the comfortable enjoyment of life or property; construction waste; tree limbs and shrubbery clippings over six (6) feet in length and greater than twelve (12) inches in diameter; automobile bodies; used oils and refrigerants from white goods; materials requiring special disposal practices, as adopted by the Arizona Department of Environmental Quality, or prohibited from disposal at a sanitary landfill.

    Putrescible means any organic waste which is capable of being decomposed by microorganisms.

    Recyclable material means any post-consumer material designated by the director and which may be collected, separated, cleaned, treated or reconstituted and returned to the economic stream in the form of raw materials or products.

    Refuse means all putrescible and nonputrescible solid wastes, except human bodily wastes, including garbage, trash, rubbish, ashes, street cleanings and dead animals; abandoned, wrecked or junked vehicles or parts thereof; brushable material, and containable rubbish, filth, construction waste and prohibited substances when these terms are not specifically noted in this article.

    Residential establishment means all residential dwelling units, including single-family dwellings, duplexes, mobile home parks, trailer parks, rooming houses, boarding houses, and multifamily units such as apartments, condominiums, and townhouse complexes except those multifamily units authorized for commercial services by the director of solid waste management.

    Residential recyclable material generator means any person generating recyclable material other than a commercial recyclable material generator.

    Residential refuse generator means any person generating refuse other than a commercial refuse generator.

    Reuse means the return of a commodity into the economic stream for use in the same kind of application as before without change in its identity.

    Solid waste means refuse, debris, filth and all other discarded materials.

    Trash means all nonputrescible solid wastes consisting of both combustible and non-combustible solid waste material.

    User means any person, party or premises serviced by any of the city solid waste management programs.

    Vector means rodents, flies and mosquitoes capable of transmitting disease to humans.

    White goods means manufactured items such as washers, dryers, stoves and water heaters and may also include refrigerators, heat pumps, freezers, dehumidifiers, vending machines, water coolers or any appliance, that usually contains refrigerants.
